OpenSky Fremont Sunrooms provides sunroom design, installation, construction, and related services (the "Services") to residential and commercial customers in Fremont, California and surrounding areas. Our Services include, but are not limited to, custom sunroom design, four-season and three-season sunroom installation, patio enclosures, screen rooms, solariums, and related construction work.
We provide free on-site estimates for our Services. All estimates are based on the information provided by you and our assessment of your property at the time of the consultation. Estimates are valid for 30 days from the date provided unless otherwise stated.
The final price for Services is subject to the terms outlined in the written contract or agreement between you and OpenSky Fremont Sunrooms. Prices may change if you request changes to the scope of work, if unforeseen site conditions are discovered, or if material costs increase significantly between the estimate and the start of work.
All prices quoted are estimates only and are not binding until a signed contract or agreement is executed by both parties.
Once you accept our estimate and sign a contract, we will schedule your project based on availability. We will make every effort to complete your project within the timeframe discussed, but timelines may be affected by weather, permit delays, material availability, or other factors beyond our control.
If you need to cancel or reschedule a consultation or project, please notify us as soon as possible. Cancellations made after work has begun may be subject to charges for labor, materials, and other costs already incurred.
We reserve the right to cancel or reschedule work due to weather, safety concerns, or other unforeseen circumstances. We will notify you promptly of any changes to the schedule.
Payment terms will be outlined in your written contract. Typically, we require a deposit before work begins, with the balance due upon completion of the project and your approval of the work. We accept payment by check, cash, or other methods as agreed upon in writing.
If payment is not received by the due date, we reserve the right to charge late fees and to suspend or terminate work until payment is received. Unpaid balances may be subject to interest charges and collection actions.
You are responsible for obtaining any necessary financing for your project. We do not provide financing directly, but we may be able to refer you to third-party lenders.
We will obtain all necessary building permits and schedule required inspections for your project as specified in your contract. You are responsible for ensuring that your project complies with any homeowners association (HOA) rules, deed restrictions, or other private agreements affecting your property. We are not responsible for delays or issues arising from HOA approvals or private restrictions.
We stand behind the quality of our work. We provide a workmanship warranty for the Services we perform, as specified in your written contract. This warranty covers defects in workmanship but does not cover damage caused by misuse, neglect, accidents, acts of nature, or normal wear and tear.
Materials and products used in your project may be covered by manufacturer warranties. We will provide you with any applicable warranty documentation. We are not responsible for defects in materials or products beyond what is covered by the manufacturer's warranty.
To make a warranty claim, you must notify us in writing within the warranty period. We will inspect the issue and, if it is covered by our warranty, repair or correct the defect at no additional charge to you.
To the fullest extent permitted by law, OpenSky Fremont Sunrooms and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our Services or your use of our Site, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or related to our Services or these Terms will not exceed the amount you paid us for the Services giving rise to the claim. Some states do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless OpenSky Fremont Sunrooms and its owners, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your breach of these Terms, your use of our Site, or your violation of any law or the rights of any third party.
If a dispute arises between you and OpenSky Fremont Sunrooms, we encourage you to contact us first to try to resolve the matter informally. If we are unable to resolve the dispute informally, you and we agree that any legal action or proceeding arising out of or related to these Terms or our Services will be brought exclusively in the state or federal courts located in CA, and you and we consent to the jurisdiction of those courts.
To the extent permitted by law, you and we agree to waive any right to a jury trial in any legal proceeding arising out of or related to these Terms or our Services.
These Terms and any disputes arising out of or related to these Terms or our Services will be governed by and construed in accordance with the laws of the State of CA, without regard to its conflict of law principles.
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable.
These Terms, together with any written contract or agreement for Services and our Privacy Policy, constitute the entire agreement between you and OpenSky Fremont Sunrooms regarding your use of our Site and Services, and supersede any prior agreements or understandings, whether written or oral.
